Do I still need a Will if I don’t own my home?

Yes — you probably still need a Will even if you don’t own a home. Owning real estate is just one of many reasons to have a Will. Here’s why it can still be very important:

1. You Likely Own Other Things That Can Be Given Away Through A Will:

Even without a house, you may, still have assets to give away to those you love:

  • Bank accounts (without a beneficiary listed)
  • Vehicles
  • Personal belongings (furniture, electronics, jewelry, etc.)
  • Retirement accounts (especially if no beneficiary is listed)
  • Digital assets (email, crypto, online businesses)

A Will lets you decide who gets what.

2. You Can Name a Guardian for Your Children

If you have minor children, a Will lets you legally name the person you want to raise your children if something were to happen to you.

Without a Will, a court picks a guardian — and it likely could be someone you wouldn’t have chosen.

3. You Choose Who Manages Your Estate

A Will lets you name a trusted Executor (personal representative) to handle your affairs after you die. This person:

  • Collects your assets
  • Pays off your debts
  • Distributes items to your beneficiaries

Without a Will, the court appoints someone — which can lead to confusion, delays, or family disputes.

4. It Prevents Intestacy (and Family Fights)

If you die without a Will, your estate is handled under your state’s intestacy laws, which may not reflect your actual wishes. For example:

  • A partner you live with but aren’t married to might get nothing;
  • A distant relative might get more than a close friend; or
  • Your step-child/step-parent might get nothing.

5. You Can Leave Specific Instructions

Even without major assets, you might want to:

  • Leave sentimental items (like letters, photos, heirlooms) to specific people;
  • Leave money to a charity;
  • Specify burial or cremation wishes.

Bottom Line:

You don’t need to be wealthy or own a home to make a Will worthwhile. If you care about what happens to your stuff, your children, or your legacy, a Will is still a smart and caring move.
